Memorandum of Agreement between

the Government of the United States of America
Regarding the Agreed Recommendation for Implementation of the Agreement
Between the Republic of Korea and the United States of America on the Relocation of
United States Forces From the Seoul Metropolitan Area


The Government of the Republic of Korea and the Government of the United States of America have agreed, through the Joint Committee established in accordance with Article XXVIII of the Agreement under Article IV of the Mutual Defense Treaty between the Republic of Korea and the United States of America, Regarding Facilities and Areas and the Status of United States Armed Forces in the Republic of Korea, as amended (SOFA), to approve the Agreed Recommendation of the Ad Hoc Subcommittee for the Yongsan Relocation Plan, as annexed hereto, subject to the provisions of Paragraph 7 thereof regarding entry into force of the Agreement between the Republic of Korea and the United States of America on the Relocation of United States Forces from the Seoul Metropolitan Area and upon entry into force of the Agreement between the Republic of Korea and the United States of America amending the Agreement between the Republic of Korea and the United States of America for the Land Partnership Plan of March 29, 2002.

The undersigned, being duly authorized by their respective Governments, have signed this Memorandum in duplicate at Seoul on this ---- day of ---- 2004, in the Korean and English languages, both texts being equally authentic.

MEMORANDUM FOR The Joint Committee


SUBJECT: Agreed Recommendation for Implementation of the Agreement between The Republic of Korea and the United States of America on The Relocation of United States Forces From The Seoul Metropolitan Area (Yongsan Relocation Plan)


1. References:

a.  Mutual Defense Treaty between the Republic of Korea (ROK) and the United States of America (US), signed October 1, 1953.

b.  Agreement under Article IV of the Mutual Defense Treaty between the ROK and the US Regarding Facilities and Areas and the Status of United States Armed Forces in the Republic of Korea (SOFA), signed July 9, 1966 as amended February 1, 1991 and January 18, 2001.

c.  Memorandum of Agreement (MOA) between the ROK Ministry of National Defense (MND) and the United States Forces in Korea (USFK) the Concerning Agreements-in-Principle for Relocation of US Forces from the Seoul Metropolitan Area, signed June 25, 1990.

d.  Memorandum of Understanding (MOU) between the ROK MND and the USFK and Concerning the Memorandum of Agreement of June 25, 1990 for Relocation of US Forces from the Seoul Metropolitan Area, signed June 25, 1990.

e.  Action of the US-ROK SOFA Joint Committee recording approval on 20 May
1991 to recognize the MOA referred to in paragraph c, above under the (SOFA), Articles II and V "Minutes of the 169th US-ROK SOFA Joint Committee Meeting", paragraph 13 and Enclosure 19, June 7, 1991.

f.  Joint Environmental Information Exchange and Access Procedures, with Tab A (Procedures for Environmental Survey and Consultation on Remediation for Facilities and Areas Designated to be Granted or Returned), approved by the SOFA Joint Committee on 30 May 2003.

g.  Agreement Between The Republic Of Korea and The United States Of America On The Relocation Of US Forces From The Seoul Metropolitan Area (Yongsan Relocation Plan), signed _____________, 2004.

h.  Agreement Between The Republic Of Korea and The United States Of America For The Land Partnership Plan signed 29 March 2002, as amended, 2004.


2.   Pursuant to Article 3, paragraph 1, and Article 6 of the Yongsan Relocation Plan, the Ad Hoc Subcommittee for the Yongsan Relocation Plan (YRP Ad Hoc Subcommittee) is to develop the Agreed Recommendation that defines detailed procedures, terms and conditions under which the Parties shall implement the references through the SOFA Joint Committee. This Agreed Recommendation (AR), along with the Yongsan Relocation Plan in reference 1.g above, shall supersede references 1.c and 1.d above.



3.   Planning and Programming Requirements:


a.  The procedures for planning, programming, design, and construction shall be in accordance with the Engineering Memorandum of Understanding for the Yongsan Relocation Plan approved by the SOFA Joint Committee.

b.  The parties shall jointly develop a comprehensive Master Plan using the procedures cited in paragraph a. above. The comprehensive Master Plan will provide

programming documentation for facilities required to implement the Yongsan Rerocation Plan, to include new and modified buildings, utilities, roads and grounds, and command control communications computers and information infrastructure.


4.  Facilities and Areas:


a.  The ROK grant of the use of facilities and areas to the US needed for the relocation of United Nations Command (UNC), Combined Forces Command (CFC), and United States Forces Korea (USFK) units from the Seoul metropolitan area, and the US return of existing facilities and areas to the ROK, shall be executed in accordance with the SOFA Facilities and Areas Subcommittee procedures. The grant and return of facilities and areas, as well as removal of encroachments from the granted areas, will be executed on the mutually agreed timetable.

b.  Use of the land required to implement the Yongsan Relocation Plan will be granted to the US by 2005. The precise size and boundaries of land to be granted shall be determined by joint survey and submitted to the SOFA Joint Committee for approval. The Eighth US Army Golf Course, Camp Isabell, Seoul Club, and other facilities previously returned in accordance with the references shall be considered part of the entire relocation.

c.  The Parties shall accomplish all required actions to facilitate the US return of the following UNC, CFC, and USFK facilities and areas in Seoul in accordance with the timeline below.

d.  The US shall return Camp Gray and Camp Kim in accordance with the Land Partnership Plan. The Parties shall proceed with construction of replacement facilities in accordance with the Land Partnership Plan. Expenses required to relocate the missions and functions currently at Camp Gray and Camp Kim out of the Seoul metropolitan area will be provided under the Yongsan Relocation Plan.

e.  Prior to the grant or return of facilities and areas, environmental actions and consultations as agreed in reference 1.f will be planned and executed. The completion of such environmental procedures may be deferred if special conditions are mutually agreed to facilitate the relocation.

f.  Major Organization Locations:

(1) The Headquarters of UNC, the Headquarters of CFC, the Headquarters of USFK, and associated units and agencies shall relocate to Camp Humphreys, as augmented by additional land to be acquired and granted to the US.
(2) The Headquarters of Eighth United States Army, its major subordinate units now in Seoul, and associated agencies shall relocate to Camp Humphreys, as augmented by additional land to be acquired and granted to the US.
(3) Other USFK units, agencies, and missions and functions shall relocate to Osan Air Base, Camp Humphreys, Camp Carroll, or Camp Henry in accordance with the approved Master Plan.
(4) UNC, CFC, and USFK shall maintain elements in Seoul to facilitate liaison with ROK government agencies. ROK MND will provide space for these liaison elements. The ROK shall operate and maintain a helipad in the vicinity of ROK MND, and provide access to this helipad for UNC, CFC, and USFK.
(5) USFK will retain the Dragon Hill Lodge complex on Yongsan South Post, and a communications facility on Camp Morse. The final boundaries and scope of facilities retained by USFK in Seoul shall be determined as part of the comprehensive Master Plan approved by the SOFA Joint Committee. The ROK will provide facilities as required to ensure access and force protection for these retained facilities.



5.  Funding:   The Parties shall mutually develop detailed procedures to review, validate, and fund expenses incurred in implementing the Yongsan Relocation Plan. These procedures shall be developed by a Joint Working Group appointed by the YRP Ad Hoc Subcommittee, and approved by the SOFA Joint Committee.


6.  Amendments:  Recommendations for amendments may be submitted with the consent of both Parties at any time. Requests for amendments will be made at least sixty (60) days in advance of the desired effective date of the amendment. Amendments approved by the SOFA Joint Committee shall enter into force on the date when the Parties notify each other of the completion of their respective legal requirements for the implementation of the amendment. Approved amendments will be consecutively numbered and attached to this AR.


7.  Entry into Force:  This AR shall enter into force on the date the Parties exchange written notifications that their respective legal requirements for the entry into force of the Agreement Between The Republic Of Korea and The United States Of America On The Relocation Of US Forces From The Seoul Metropolitan Area (Yongsan Relocation Plan) have been fulfilled.
